Terms of Service

By accessing or using the Percio platform at percio.app, including the web application, CLI tool, API, and MCP server (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Percio ("we," "us," or "our"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Percio is an AI-powered usability testing platform. The Service uses artificial intelligence to autonomously navigate web pages, simulate user interactions through configurable personas, and generate usability reports based on established UX heuristics.

The Service includes the Percio web application, the Percio CLI tool, the Percio API and MCP server, and all related documentation and support materials.

You must create an account to use the Service. You agree to provide accurate and complete information during registration, maintain the security of your account credentials, promptly notify us of any unauthorized access to your account, and accept responsibility for all activity under your account.

You must be at least 16 years old to create an account and use the Service.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

• Use the Service to test websites or applications you do not own or have authorization to test.
• Attempt to circumvent rate limits, access controls, or security measures of the Service.
• Use the Service in any way that could damage, disable, or impair its functionality.
• Use the Service to engage in any form of automated scraping, data mining, or data extraction beyond the intended testing functionality.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or redistribute access to the Service without our written consent.
• Use the Service to test websites containing illegal content.

Your Content. You retain ownership of the URLs you submit and any configuration data you provide (personas, scenarios, etc.). You grant us a limited, non-exclusive license to process this content solely for the purpose of performing usability tests and delivering results.

Generated Results. Test results, including AI-generated analysis, usability findings, and flow evaluations, are generated by the Service and provided to you for your use. You may use these results internally and share them with your team.

Screenshots. During test execution, the Service captures screenshots of the target URL. You represent that you have the right to capture and analyze content from the URLs you submit for testing. We store screenshots solely for delivering your test results and do not use them for any other purpose.

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of purchase. All payments are processed securely through Stripe. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan). You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' notice. Refunds are handled on a case-by-case basis at our discretion.

The Service uses artificial intelligence (Anthropic's Claude) to perform automated browsing and usability analysis. You acknowledge that:

• AI-generated results are probabilistic and may not capture every usability issue.
• The Service is a complement to, not a replacement for, human usability research.
• AI personas simulate user behavior but do not represent actual human users.
• Results should be interpreted as directional insights, not definitive assessments.
• Automated browsing may trigger rate limits, CAPTCHAs, or security measures on target websites — this is outside our control.

The Service, including its design, code, AI models integration, branding, and documentation, is owned by Percio and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets.

We respect the intellectual property of others. If you believe content on the Service infringes your copyright, please contact us at legal@percio.app.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated analysis or test results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERCIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Percio and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or the URLs and content you submit for testing.

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment of fees, or at our discretion with reasonable notice. You may terminate your account at any time by contacting us or through the account settings. Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service.

Governing Law. These Terms are governed by the laws of the jurisdiction in which Percio is incorporated, without regard to conflict of law principles.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Percio regarding the Service.

Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
